Defending Estate Claims
If you are the Executor of a Will and someone commenced legal action against the Estate, our team can advise and assist you through the dispute process, which can look different depending on the type of action taken against the Estate.
Intestacy
If your loved one does not have a valid Will when they pass away, then the Intestacy Rules will apply. These Rules govern who can administer the Estate, as well as the distribution of the Estate. We can help you navigate these rules and assist you as necessary.
Family Provision Applications
If you believe you have not been adequately provided for under a deceased’s Will, then you may be eligible to make a Family Provision claim in Queensland if you meet one of the following criteria:
- spouse; or
- child; or
- dependent, namely someone who was wholly or substantially maintained or supported by the deceased at the date of the deceased’s death.
If you intend to make a Family Provision claim, then you must notify the Estate within 6 months from the date of death, and file your claim with the Court within 9 months from the date of death.
