A Statutory Will is a Court ordered new Will or an amendment to a Will for someone who does not have the capacity to make a Will themselves.

There are two types of incapacity:

  1. People who have never had capacity due to injuries at birth; or
  2. People who have lost capacity after an accident or illness during life.

Given Australia’s ageing population and increasing life expectancy, it is important to know that an incapacitated person is not necessarily stuck with a previous Will if they have lost capacity, or no Will if they have never had capacity.
