The traditional practice with respect to disputes is that a party will file an application, the other party will respond and the dispute will run its course through the Court until the Court determines which party is successful.

Nextgen.Law is well-versed in traditional dispute practice but it is our preference to resolve disputes as early as possible (by collaborative practice, or early without prejudice conferences/mediation) due to the significant time and cost involved with traditional litigation. For example, there are a number of steps in traditional litigation of a Family Provision Application, and mediation only comes into play at a later stage. This means more legal fees than if parties were willing attend earlier roundtable meetings.
